European works in the AVMSD

What does the AVMSD have in store for the promotion of European works?

The AVMSD, as amended by Directive 2018/1808 of the European Parliament and of the Council of 14 November 2018 introduced a series of obligations on linear (broadcasters) and non-linear (video-on-demand) audiovisual media service providers.

Article 13(1) establishes that member states shall ensure that media service providers of on-demand audiovisual media services under their jurisdiction secure at least a 30% share of European works in their catalogues and ensure prominence of these works.

Article 13(2) provides that member states requiring media service providers to contribute financially to the production of European works (via direct or indirect investments) may also require media service providers targeting audiences in their territories but established in other member states to make such financial contributions.

While the provisions of Articles 13(1) and (2) apply to both linear and non-linear services, Article 16(1) provides that member states shall ensure that broadcasters reserve a majority proportion of their transmission time, excluding the time allotted to news, sports events, games, advertising, teletext services and teleshopping.

Article 17 establishes that member states shall ensure that broadcasters reserve at least 10% of their transmission time (excluding the time allotted to news, sports events, games, advertising, teletext services and teleshopping) or 10% of their programming budget for European works created by producers who are independent of broadcasters.

As per Article 4(1), member states also remain free to require media service providers under their jurisdiction to comply with more detailed or stricter rules. This include setting up stricter quotas and implementing specific sub-quotas.
